Richard H. Cross, Jr. is the founder of the firm. Before establishing Cross & Simon in 2002 he was a litigator with Young, Conaway, Stargatt & Taylor, a leading general litigation and bankruptcy firm in Wilmington. Prior to that, he was a litigator with Morris, Nichols, Arsht & Tunnell, another leading Delaware law firm. Mr. Cross began his legal career as law clerk for the Honorable Jerome O. Herlihy of the Superior Court of the State of Delaware.
Mr. Cross regularly represents local, regional, national and international clients in commercial and corporate disputes. He appears in matters before the Delaware Supreme Court, Chancery Court and Superior Court. He also practices in the United States District Court for Delaware and the Third Circuit Court of Appeals. Examples of the types of matters he handles:
- Obtaining injunctive relief to protect client’s exclusive license to sell a product;
- Enforcing the terms of an asset purchase agreement on behalf of the seller of a large commercial property;
- Defending clients accused of tortious interference with a business they previously sold;
- Enforcing the terms of a consulting agreement relating to an international business venture;
- Seeking declaratory relief concerning the obligations under a stockholder lockup agreement.
Mr. Cross received his Juris Doctorate from the Marshall-Wythe School of Law at the College of William & Mary in Williamsburg, Virginia in 1996. He received his Bachelor of Arts degree from the State University of New York at Binghamton in 1988.
Between college and law school, he served as an officer in the United States Navy where his primary responsibility was as a navigator on the F-14 Tomcat. Among other accomplishments, Mr. Cross earned two strike-flight air medals for his participation in Desert Shield and Desert Storm where he flew more than 40 combat missions over Iraq.
Mr. Cross is a regular lecturer on continuing legal education topics relating to commercial and civil litigation. He acts as an arbitrator for the Delaware chapter of the Better Business Bureau. He is a member of the Delaware State Bar Association, the Delaware Trial Lawyers Association and the American Bar Association. He is a member of the National Trial Lawyers where he was selected to the Top 100 Trial Lawyers in 2011 and 2012.
He lives in Wilmington with his sons, Will, Henry and George.
